Welcome to the Little Sunny Coast community. We are so glad you are here!

Little Sunny Coast is a space for guardians and parents to find the good stuff on the Sunshine Coast, share the mental load, and have a bit of fun along the way. Your membership is our way of bringing you closer to the businesses, events and little extras we love.

These Subscription Terms explain how your membership works, what you get, and the few house rules that keep our community lovely for everyone. We have kept them as friendly and plain as we can, but they are still the terms that apply to your membership, so please have a read.

By subscribing, you agree to be bound by these Subscription Terms and our Privacy Policy. If anything is not clear, just ask us, we are always happy to help.

Unless we say otherwise, capitalised words have the meaning given to them in clause 1.

1.  Definitions

First, a few quick definitions so we are all on the same page about the words we use throughout these terms.

1. Applicable Law means any applicable statute, regulation, by-law, ordinance, policy or subordinate legislation in force from time to time in Australia.
2. Benefits means the membership benefits made available to Members from time to time, which may include exclusive content, exclusive discounts and discount codes, brand exclusives, exclusive invitations to events including mumma meet ups, and entry to Giveaways.
3. Claim means any claim, demand, remedy, suit, injury, damage, loss, cost, liability, action, proceeding, right of action or claim for compensation, however arising.
4. Giveaway means any competition, prize draw or giveaway we make available to Members.
5. Little Sunny Coast, we, us or our means Little Sunny Coast Pty Ltd (ACN 702 601 232) (ABN 56 702 601 232) trading as Little Sunny Coast.
6. Member, you or your means a person who subscribes to the Little Sunny Coast subscription.
7. Personal Information has the meaning given in the Privacy Act 1988 (Cth).
8. Subscription means the paid membership to Little Sunny Coast governed by these Subscription Terms.
9. Subscription Term means the subscription period you select when you subscribe, being the period advertised for your plan (for example monthly, quarterly or annual), and each successive period of the same length for which your Subscription renews.
10. Website means the website located at https://littlesunnycoast.com.au.

2.  Your Subscription

Here is the heart of what you are joining, and a couple of things we need you to know up front.

1. The Subscription is a paid membership to the Little Sunny Coast community, created to bring you closer to the businesses, events and little extras we love.
2. You must be at least 18 years of age to subscribe and to hold a membership.
3. By subscribing, you become a Member for the Subscription Term you select and agree to be bound by these Subscription Terms and our Privacy Policy.
4. Your membership is personal to you. It must not be shared, transferred, on-sold or used by any other person.
5. We would love for the Subscription to be a great fit, so please take a moment to satisfy yourself, before subscribing, that the Subscription and its Benefits are right for you.

3.  Subscription Plans and Term

You choose the plan that suits your family, and here is how the plans and terms work.

1. You may select from the subscription plans we advertise from time to time, which may include monthly, quarterly or annual plans.
2. The subscription fee and the length of your Subscription Term are as advertised at the time you subscribe.
3. Your Subscription Term begins on the date you subscribe and continues for the period advertised for your plan.
4. Your Subscription automatically continues and renews for successive Subscription Terms of the same length, paid by your nominated payment method, unless and until you cancel in accordance with clause 9.
5. We may change our plans, pricing or Benefits from time to time. We will give you reasonable notice of any change to the price of your Subscription before it takes effect, and the change will apply from your next Subscription Term.

4.  Membership Benefits

Now for the good stuff. This is what being part of the Little Sunny Coast community brings you, and we want you to enjoy every bit of it.

1. Your membership may include exclusive content, exclusive discounts and discount codes, brand exclusives, exclusive invitations to events including mumma meet ups, and entry to Giveaways.
2. The Benefits reflect our own experience and the businesses and treats we genuinely love, and they are provided at our discretion. We may vary, add to, refresh, reduce or withdraw any Benefit from time to time as our community grows and changes.
3. The Benefits are personal to you as a Member and are not transferable.
4. Because we are always mixing things up, we do not guarantee that any particular content, discount, offer, event or Giveaway will be available at any given time.

5.  Exclusive Discounts, Vouchers and Offers

We love finding you a good deal, and we work hard to bring you exclusive discounts and vouchers. Here are a few honest things to know about how they work.

1. We may make exclusive discounts, discount codes, vouchers, offers and deals available to Members.
2. Discounts, vouchers and offers are often kindly provided by venues and other third parties and may be limited in number. We will always do our very best to source enough for our Members, however we cannot guarantee availability, and offers may be available on a first in, best dressed basis.
3. Discounts, vouchers and offers may also be capped, subject to availability or offered for a limited time only. So you do not miss out, please check in advance that an offer is available and act promptly to secure it before relying on it.
4. Where a discount, voucher or offer is provided by a third party, we are not responsible for that third party’s failure to honour it, and any dealing with a third party is solely between you and that third party.

6.  Events and Mumma Meet Ups

Getting together in real life is our absolute favourite part. Here is how our events and mumma meet ups work.

1. From time to time we may invite Members to events, including mumma meet ups and other community gatherings, and we would love to see you there.
2. Events may be limited in capacity, subject to registration, and subject to any specific event terms we publish at the relevant time.
3. Some events are ticketed. Where an event is ticketed, the ticket price and any terms for that event will be advertised when the event is released, and payment is required to attend.
4. A $5 fee applies to attend each mumma meet up. This fee is refundable if you cancel at least 24 hours before the event, and is non-refundable if you cancel less than 24 hours before the event or do not attend. This applies to all mumma meet ups.
5. Where an event is held at a third-party venue, we act as host or organiser only and are not responsible for the venue, its premises, products or staff. You attend at your own risk.
6. You are responsible for supervising your children at all times at any event, and for assessing the suitability and safety of the event for you and your family.

7.  Giveaways

Who does not love a giveaway? We run them purely for the joy of it, and these are the rules so everyone gets a fair go.

1. We may run Giveaways for Members from time to time. Each Giveaway may be subject to additional specific terms that we publish, and by entering you agree to those terms and these Subscription Terms.
2. You must be at least 18 years of age and a current Member to enter a Giveaway.
3. Giveaway winners are drawn at random and at our sole discretion. Our decision is final and we will not enter into correspondence about it.
4. We may verify a winner’s eligibility and may redraw and select another winner if an entrant does not meet the eligibility requirements or has breached these Subscription Terms.
5. If you win, we will notify you using the contact details we hold for you. You must accept and collect your prize within two (2) weeks of being notified. If you do not, or if we are unable to contact you, you forfeit the prize and we may pass it to another Member.
6. Prizes are as described, are not transferable and are not redeemable for cash. Where an advertised prize becomes unavailable, we may substitute a prize of equal or greater value.
7. Where a prize is provided by a third party, we are not responsible for the prize or for the third party’s failure to provide it.
8. By entering, you consent to us sharing your first name, suburb and social media handle, and announcing that you are a winner, on our channels. You may withdraw this consent at any time by contacting us.
9. Each Giveaway is conducted by us and is in no way sponsored, endorsed, administered by or associated with any social media platform, and you release each platform from any liability in connection with a Giveaway.
10. Giveaways may be limited or capped and are conducted in accordance with all Applicable Laws.

8.  Fees and Direct Debit

The money side, kept simple and clear so there are no surprises.

1. The subscription fee for your selected Subscription Term is the amount set out at the time you subscribe. All fees are payable in advance.
2. You must pay your subscription fee by the payment method you select at sign up. By subscribing, you authorise us to charge or debit the subscription fee from your nominated account or payment method at the start of each Subscription Term, until you cancel in accordance with clause 9.
3. Payments are managed on our behalf by a third-party payment processor.
4. You are responsible for ensuring sufficient funds are available. If a payment fails or is dishonoured, we may retry the payment, suspend your membership and Benefits until payment is received, and recover any amount owing.
5. We may charge interest on any overdue amount at a rate of up to 10% per annum, calculated from the due date until the date of payment in full.

9.  Cancellation

Life gets busy and things change, and that is completely okay. You can cancel whenever you need to, and here is how it works.

1. You may cancel your Subscription yourself at any time by managing your Subscription through the method we make available, or by reaching out to us.
2. You cannot cancel or exit your Subscription part-way through your current Subscription Term. Your cancellation takes effect at the end of your current Subscription Term.
3. To cancel and stop your Subscription renewing, please give us at least seven (7) days notice prior to the end of your current Subscription Term. If you give less than seven (7) days notice, your cancellation will take effect at the end of the following Subscription Term.
4. If something is not sitting right, we would genuinely love the chance to make it better, so please tell us. You may raise any issue with us and provide at least seven (7) days notice prior to the end of your current Subscription Term.
5. You will continue to enjoy your Benefits until the end of the Subscription Term for which you have paid.

10.  No Refunds

One we want to be upfront and honest about, so you know where you stand.

1. Due to the nature of the membership and the Benefits, all subscription fees are non-refundable once a Subscription Term has commenced.
2. No refund is payable for change of mind, a decision to cancel, non-use of the Benefits, or your failure to attend an event or use a discount, offer or Giveaway.
3. We do not provide refunds for any unused part of a Subscription Term.

11.  Community Standards

This is the one that matters most to us. Little Sunny Coast is a warm and inviting space, and it only stays that way because of the people in it.

1. We want you here, and we want you to have fun. In return, we ask that you help us keep our community a supportive, positive and safe place for everyone.
2. As a Member, you agree to:
   1. be kind, respectful and encouraging towards us, our team, other Members and any guests;
   2. support and lift up others in the community, and cheer each other on; and
   3. respect that others may hold different views, and not push, force or impose your views, beliefs or opinions on others.
3. You must not engage in any conduct that is unkind, harmful, disruptive, abusive, bullying, harassing, discriminatory, hateful or offensive, and please do not use the community to spam or to promote your own products or services without our permission.
4. If these standards are not met:
   1. where the breach is serious, we may remove you and end your membership immediately and without warning; and
   2. where the breach is not serious, we will give you a friendly warning and a chance to put things right before we take any further action.
5. Any removal or termination under this clause is without refund.

12.  Suspension and Termination

We truly hope it never comes to this, but we need to be clear about it just in case.

1. We may suspend or terminate your membership immediately if you breach these Subscription Terms, fail to pay any fee, or engage in conduct contrary to our community standards.
2. We may also decide to wind up the Subscription, or any Benefit, at our discretion, in which case we will give you reasonable notice.
3. On suspension or termination, your access to the Benefits ends, and any fees paid remain non-refundable except to the extent required by law.

13.  Intellectual Property

A quick note on the lovely content and materials we share with you as a Member.

1. All exclusive content and materials provided to Members are owned by us or used with permission, and are protected by Applicable Law.
2. Member content is provided for your own personal, non-commercial use only. Please do not copy, share, reproduce, republish, distribute or commercially exploit any Member content or Benefit without our prior written consent.

14.  Privacy

Your privacy matters to us. We collect, hold, use and disclose your Personal Information in accordance with our Privacy Policy, which is available on the Website and forms part of these Subscription Terms.

15.  Liability and Australian Consumer Law

The legal bit about responsibility. Your rights under the Australian Consumer Law always come first, and nothing here takes them away.

1. Nothing in these Subscription Terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred by the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law, or any other Applicable Law that cannot lawfully be excluded, restricted or modified.
2. Where our liability cannot be excluded but can be limited, our liability is limited, at our option, to resupplying the relevant Benefit or paying the cost of having it resupplied.
3. To the maximum extent permitted by law, we are not liable for any indirect or consequential loss, or for any loss arising from the act, omission, product, service or conduct of any third party, including any third-party venue, business or offer.

16.  Changes to these Terms

Things evolve, and every now and then these terms will too.

1. We may update these Subscription Terms from time to time by publishing the updated version on the Website.
2. Changes take effect from your next Subscription Term, or as otherwise notified to you.

17.  General

A few final housekeeping bits to round things off.

1. If any provision of these Subscription Terms is found to be invalid, illegal or unenforceable, it may be read down or severed to the extent necessary, and the remaining provisions continue in full force and effect.
2. A failure or delay by us to exercise any right does not operate as a waiver of that right.
3. You must not assign or transfer your membership or your rights under these Subscription Terms. We may assign, novate or transfer our rights without your consent.
4. These Subscription Terms, together with our Privacy Policy, are the entire agreement between you and us in relation to your membership.

18.  Governing Law and Jurisdiction

1. These Subscription Terms are governed by the laws of Queensland, Australia.
2. You submit to the non-exclusive jurisdiction of the courts of Queensland and the courts competent to hear appeals from those courts.
